Terms of Service

Effective: January 2024

1. Acceptance

By engaging ConstructionAgency.ca, you accept these Terms of Service. If there is a conflict between these terms and a signed service agreement, the signed agreement prevails.

2. Services

We provide marketing services as outlined in your statement of work or service proposal. Changes to scope require written agreement from both parties.

3. Client Cooperation

Clients must provide timely access to platforms, brand assets, project information, and subject matter experts needed to execute the marketing plan.

4. Payment

Monthly fees are invoiced in advance and due within 15 days. Late payments may result in a 1.5% monthly finance charge and service suspension after 45 days.

5. Ownership

Final deliverables become client property upon full payment. We retain the right to use completed work for portfolio and marketing purposes.

6. Liability

Our liability is limited to fees paid for the service giving rise to the claim. We are not liable for consequential damages including lost project revenue or bid opportunities.

7. Termination

Either party may terminate with 30 days written notice. Client shall pay for all services rendered through termination date.

8. Jurisdiction

These terms are governed by the laws of British Columbia, Canada. Disputes shall be resolved in the courts of British Columbia.
